Jury Rules In Favor of Reynolds American, Inc.'s R.J. Reynolds Tobacco Company In Patent Suit Against Star Scientific, Inc.

Reynolds American, Inc.'s R.J. Reynolds Tobacco Company announced the jury verdict in favor of R.J. Reynolds in a patent infringement lawsuit brought by Star Scientific, Inc. (Star) in the U.S. District Court for Maryland - Northern Division. The jury ruled the patents in question, involving a method of treating tobacco to substantially prevent the formation of tobacco specific nitrosamines (TSNAs), were invalid and not infringed. Star filed the suit on May 23, 2001 and sought hundreds of millions of dollars in damages for past alleged infringement and an injunction going forward to prevent future alleged infringement.

(RAI) shares are rising today after federal jury ruled that the company did not infringe upon Star Scientific Inc.'s (STSI) patents regarding a method to reduce cancer-causing toxins in tobacco. The jury determined the two STSI patents at issue were not valid. STSI is expected to file an appeal.

Star Scientific Breaks New Ground, Plans FDA Filing for Approval of First 'Modified Risk' Tobacco Product; Nominates Curtis Wright, MD, MPH for FDA Advisory Committee

PETERSBURG, Va., Sept 22, 2009 /PRNewswire-FirstCall via COMTEX/ -- Star Scientific, Inc. makers of low-nitrosamine smokeless tobacco products, announced today that the company will utilize a novel, patented method for cultivation, curing and preparation of tobacco to formulate dissolvable smokeless tobacco products. This new curing process was the subject of a patent application filed in December, 2008. Its use has resulted in tobacco leaf with significantly lower levels of tobacco-specific nitrosamines (TSNAs) than previously achieved using the StarCured(R) curing process: the International Agency for Research on Cancer previously has reported on the low levels of nitrosamines in Star's products. The company believes that this novel process, as reflected in its patent application, will enable the company to achieve the lowest toxin levels anywhere in the world. Star plans to submit the products to the FDA for approval to market as "modified risk" tobacco products, under Section 911 of the new Family Smoking Prevention and Tobacco Control Act, once formulation and testing of the new product is completed in early 2010.

Closing price $1.11 (up 13.27% on 21.43 million trades). Sounds like it's back to a $5 stock soon. Unfortunately my patience is thin and I guarantee I take the 10-20% and complain 6 months down the road that the stock I bought at $1 is now trading at $5, lmao!

Star will ask for approval of lower-toxin tobacco

Star Scientific says it will ask FDA to approve new tobacco-making method early next year. PETERSBURG, Va. (AP) -- Tobacco company Star Scientific Inc. said Tuesday it will ask the Food and Drug Administration to approve a new method for making smokeless tobacco with reduced toxins.

Star Scientific said the new method of tobacco cultivation, curing and preparation is patented and will create tobacco leaves with low levels of tobacco-specific nitrosamines. The company said it believes it will have the lowest toxin levels of any tobacco product, and said it will ask for approval in early 2010, once testing is finished.

In afternoon trading, Star Scientific shares rose 12 cents, or 12.2 percent, to $1.08. The stock surged more than 22 percent earlier, and about 16.7 million shares changed hands by early afternoon. The average full day trading volume for Star Scientific shares is about 4 million.
